Against that, the Imam of the Sunehri Bagh Mosque has moved to the Delhi High Court. The vacation bench of Justice Manoj Jain has listed the petition to be heard on 08 January 2024 with the assurance that the NDMC will take no action as the final call will be made on the day of the hearing by the Heritage Conservation Committee.
The NDMC council has said that the HCC will make the decision, and we are just asking for the suggestions of the general public. They further add that they will not touch even a brick without permission from the HCC.
The court has also questioned the locus of the imam for filing the petition instead of the Delhi Waqf Board, to which the Imam of the Sunehri Bagh Mosque has said that he did that to protect his congregation because the mosque is functioning.
In the plea, the petitioner added that this heritage mosque is 150 years old and symbolizes the cultural legacy. It further said that the various government buildings, including Udyog Bhawan, Vayu Bhawan, and Udyog Bhawan Metro Station, blended harmoniously with the Masjid, which led to increased traffic in the area.
The petitioner further said that the traffic, as and when required, has been managed, sometimes using barricades.
