A two bench comprising Justices BV Nagarathna and Augustine George Masih has also declared that proof of the ceremony’s performance should be present in case any issue arises.
In straightforward words, the bench has ruled that Hindu marriage, if performed without ceremonies like saptapadi and proof of the performance of the said ceremony, will not be valid. So if parties haven’t gone through these ceremonies, the marriage will be void under Section 7 of the Act, and issuing any marriage certificate by an entity in the absence of these ceremonies will not confirm the martial status to the parties. Also, it will not establish the marriage under Hindu Law.
This action comes when a husband and wife, during their divorce proceeding, filed a joint application for a declaration that their marriage was not valid.
