A high court in Danish court refused on Thursday India’s extradition plea of Niels Holck, a native of Denmark, arrested for his alleged role in an arms trafficking conspiracy more than twenty-five years ago. The police chief’s decision came through Denmark’s top prosecuting authority, which sanctioned Holck’s extradition to India. Niels Holck, also known as Kim Davy, has been named a wanted criminal by the Indian authorities for his involvement in a 1995 event where a large consignment of weapons was airdropped in West Bengal, specifically in the Purulia district, which was supposedly meant for the insurgent groups.

Holck has been on the run for the Indian justice system, and thus, there have been several attempts to extradite him from India. India had freshly taken up the process of prosecution of Holck, and the apex prosecuting authority of Denmark had issued a ruling okaying his extradition, saying it was not forbidden to return him to stand trial. However, the Danish court followed a different approach, citing a violation of human rights and that the Indian custody was dangerous to the children.
The court’s decision is a major blow to the Indian authorities that have been pursuing Holck since early 1991. This has been one of the controversies between India and Denmark with ye ars attempt at diplomacy to try and settle the case. Holck has responded to the charges, denying them, adding that the arms drop was for a mission to support anti-communist groups in India. His defence also said that the extradition could lead to torture or inhuman treatment, hence influencing the Danish court.
